Charles Anthony Nealy, convicted on 10/12/1998 of the murder of Jiten Bhakta and Vijakumar Patel at the Expressway Mart in
South Dallas.
Described by Dallas Morning News as ‘the quickest death penalty trial in Texas history’, the case of Charles Anthony Nealy, was misconducted, manipulated, rushed and appallingly handled from beginning to end.
- The Police lost the alibi evidence, motel receipts provided by Charles Nealy which proved that he and the co-defendant, Claude, were in Oklahoma on the 20th August 1997, the evening of the murder. In addition the Police never interviewed the co-defendant’s girlfriend, who was also present in Oklahoma.
- The only eyewitness, Sam Vallabhbhai, twice failed to pick Charles from a line up. His description is of a man with gold teeth, distinctive pendant and short hair. On 08/20/97 Charles had long hair, no gold teeth and no pendant.
- Non eyewitness, Memphis Nealy has admitted in writing he was blackmailed by police to identify Charles Nealy as the man on the CCTV tape.
- There appears to have been collusion between defense and prosecution; e.g. De-selection of Black Jurors resulting in an All White Jury. This violates amendment six of the constitution specifying 'a fair cross-section of the community' .
- The defendant was held for ten hours before he was allowed to make a phone call.
- The courts admitted in November 2001 that Charles had received poor legal representation.
